Part 1 \u2013 General Conditions<\/u><\/p>\n[\/vc_column_text][vc_column_text]\n

1. Scope of Application<\/h2>\n

1.1 The quitt<\/span> Deutschland GmbH<\/span> (<\/span>hereinafter referred to as \u201c<\/span>qui<\/span>tt<\/span> GmbH<\/span>\u201c) <\/span>operates<\/span> an online platform under the abovementioned domain. On behalf of its <\/span>Customer<\/span>s, the<\/span> quitt<\/span> GmbH<\/span> administrates the employment relationships with their workforce<\/span>s<\/span> and grants the <\/span>Customer<\/span> the right to use the platform go-quitt.de and the <\/span>Customer<\/span> sections protected by a personal login for <\/span>a time period<\/span> limited to the term of the <\/span>Agreement<\/span> and the processing of the subject matter of the <\/span>Agreement<\/span>.\u00a0<\/span><\/p>\n

1.2 These General Terms and Conditions (GTC) shall apply to all <\/span>Agreement<\/span>s between the <\/span>quitt<\/span> GmbH<\/span> and its <\/span>Customer<\/span>s, <\/span>with regard to<\/span> the employment relationships that are being administrated by the <\/span>q<\/span>uitt<\/span> GmbH<\/span> via the designated platform. These GTC shall apply exclusively. Terms and conditions that deviate from the former shall not be acknowledged by the <\/span>quitt<\/span> GmbH<\/span> \u2013<\/span> unless the <\/span>quitt<\/span> GmbH has expressly consented to their applicability.<\/span><\/p>\n

1.3 The quitt<\/span> GmbH<\/span> shall have the right to amend these GTC for factually legitimate reasons (<\/span>e.g.<\/span> changes in the law, the status of the law, market conditions) subject to compliance with a reasonable advance notice period. <\/span>Existing <\/span>Customers<\/span> shall be notified of such facts no later than two weeks prior to the effective date of the amendment via email.<\/span> If the <\/span>Customer<\/span> should fail to object within the <\/span>time period<\/span> stipulated in the change notice, <\/span>Customer<\/span>\u2019s<\/span> consent to the amendment shall be <\/span>deemed<\/span> granted. The notification of the intended change to these GTC shall include alerts as to the final notification date for filing objections and as to the consequences of not sending such a notification.\u00a0<\/span><\/p>\n

1.4 The following definition of terms shall apply to these GTC:<\/p>\n

1.4.1 Customer:<\/strong> A <\/span>Customer<\/span> is any natural personal who manages his or her employment relationship that consists of mini job <\/span>hires<\/span> (\u00a7 8 <\/span>Sect<\/span>. 1 N<\/span>o<\/span>. 1 SGB IV<\/span> [German Social Security Act]<\/span>)<\/span>, <\/span>jobs within the sliding zone, so-called midi job<\/span> (\u00a7 20 Abs. 2 SGB IV<\/span>)<\/span> or <\/span>a part-time or full-time job subject to social insurance contributions<\/span> through the <\/span>platform<\/span>;<\/span>\u00a0<\/span><\/p>\n

1.4.2. Employee:<\/strong> An employee is any natural person who is in an employment relationship, <\/span>specifically a mini job <\/span>(\u00a7 8 <\/span>Sect<\/span>. 1 N<\/span>o<\/span>. 1 SGB IV)<\/span>, midi job <\/span>(\u00a7 20 Abs. 2 SGB IV) <\/span>or <\/span>a part-time or full-time job subject to social insurance contributions<\/span> relationship with the <\/span>Customer<\/span> that is being administrated via the <\/span>platform;<\/span>\u00a0<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n

1.4.3. quitt GmbH<\/strong>: The data controller of the platform as stipulated in the heading of these GTC.<\/p>\n

2. Subject Matter of the Agreement<\/h2>\n

2.1 The<\/span> quitt<\/span> GmbH<\/span> operates<\/span> and maintains an online platform that allows <\/span>Customer<\/span>s to administrate their employment relationships<\/span> with their employees. The subject matter of the services <\/span>rendered<\/span> by the <\/span>quitt<\/span> GmbH<\/span> in this context is not only the provision and maintenance of the platform, but a<\/span>lso <\/span>the following services<\/span>:<\/span><\/span>\u00a0<\/span><\/p>\n
